The Madras High Court on 12th Feb granted an interim stay on an order passed by a Commissioner of Goods and Services Tax (GST) and Central Excise on 17 Oct'19 against music composer A.R. Rahman till 4th March.Rahman was accused of having evaded Service Tax Payments from April 2013 to June 2017 amounting to Rs 6.79 crores.
Rahman's contention was that a composer of a musical work becomes the absolute owner of the copyright for their work under the Copyrights Act and subsequent transfer of such rights to producers of movies are exempted as it is not a service, even temporary transfer or permitting enjoyment of copyright falling under the Copyright Act is exempted from service tax.
